Terms and Conditions of Access and Use of the Online Space www.nima.gr.

1. GENERAL TERMS

Please read with necessary care and attention the terms and conditions of use of www.nima.gr that follow, as the unconditional acceptance of them constitutes an essential prerequisite for the registration of every user.

www.nima.gr is an online store selling products (linen, small furniture, home decor) through the Internet, owned by the anonymous company under the name «NIMA S.A. Bedlinen» and the trade name «NIMA S.A. Bedlinen», headquartered at Myrovlitissis 48, Acharnes, Attica.

The e-shop is addressed to all internet users who wish to be promptly informed about the products offered by the company in combination with the ability to make purchases through the e-shop, through remote online ordering, always subject to the availability of the company's stock.

These terms are fully compatible with the applicable European and Greek law, and users acknowledge the company's right to amend the provisions of these terms, to the extent that they do not concern legally binding obligations and without affecting completed situations.

The user of the website acknowledges that they have read these terms, agrees with them, and undertakes the obligation to comply with them. 

 

2. PARTICIPATION REQUIREMENTS

Access to www.nima.gr and, by extension, participation in online shopping, is allowed exclusively to individuals who have full legal capacity and have reached the age of eighteen (18).

Subject to the above, each user declares and expressly guarantees that during their registration on www.nima.gr, they will provide true, accurate, and complete information about themselves and that they have the necessary legal prerequisites as well as the necessary ability to understand the terms and conditions contained herein. The company is not responsible for any use and transaction through www.nima.gr by users who do not meet the above requirements.

Users must also be lawful holders of the credit, debit, or prepaid card with which they participated in an online purchase. Under no circumstances is the company liable to the legal holder of the card if the user is not the lawful holder or does not have the legal authorization to use it from the lawful holder.

4. PROHIBITIONS

Misuse of the website www.nima.gr is prohibited. Each user is prohibited from committing or encouraging any criminal offense, transmitting or distributing a virus, trojan, worm, or any other material that is malicious, technologically harmful, or in any way offensive or obscene, using software and/or other mechanisms automatic and/or manual to reproduce, copy and/or access the content of www.nima.gr in a manner inconsistent with the provisions hereof, destroy data, harass other users, violate the rights of any other person's property, send any unwanted advertising material, commonly referred to as «spam», and/or attempt to affect the performance or functionality of any computer via this website.

The company is not responsible for any loss or damage that may be caused by viruses or other technologically harmful materials that may infect the user's computer, computer programs, data, or other proprietary materials due to their use of this website or the downloading of material posted on it or on any website linked to it.

 

5. INTELLECTUAL PROPERTY, SOFTWARE, and CONTENT

All content on www.nima.gr, including images, graphics, photographs, designs, texts, and all files on this website, except explicitly stated exceptions (intellectual property rights of third parties, collaborators, and entities), constitutes intellectual property, registered trademarks, and service marks of www.nima.gr and the company "NIMA S.A. Bedlinen" and is protected by the relevant provisions of Greek law, European law, and international conventions and agreements.

Any copying, modification, alteration, translation, adaptation, reproduction, distribution, transmission, sale, republication, data uploading to another computer, in any manner or form, of any information (in its entirety, partially, or summarily) provided on this website, including their transmission on the Internet or making the information available on the Internet by any other means, without the prior written permission of the company "NIMA S.A. Bedlinen" is strictly prohibited.

 

6. TRANSACTION SECURITY

For payment transactions via credit card, the user will be redirected to the secure payment page of the Alpha e-Commerce service.

The high level of security of the Alpha e-Commerce service is ensured by the fact that card information (card number, CVV2/CVC2, expiration date) is transmitted/transferred over the Internet in encrypted form (SSL 128-bit encryption) and is not accessible by the online store under any circumstances. The systems and procedures used by Alpha Bank prevent unauthorized third parties from accessing the data and information systems.

The Alpha e-Commerce E-commerce Service follows the best international practices in the field of online commerce payments and is fully compatible with the 3D-Secure security protocols of international card organizations American Express SafeKey®, Verified by Visa, and MasterCard SecureCode for secure online card payments. With this mechanism, after entering their card details, the user will be asked to enter the 3D-Secure code to authenticate the cardholder. The authentication is done through the issuing bank, and then the customer returns to the transaction page to complete it.

The SSL (Secure Sockets Layer) protocol is the global standard on the Internet for authenticating websites to network users and for encrypting data between network users and network servers. Encrypted SSL communication requires all information sent between a client and a server to be encrypted by the sending software and decrypted by the receiving software, protecting personal information during their transfer. Furthermore, all information sent via SSL protocol is protected by a mechanism that automatically verifies whether the data has been altered during transmission.

 

7. PRODUCT ORDERS AND CONSUMER PROTECTION

Placing an order through the e-shop constitutes a distance selling contract regulated by the legislative framework of Law 2251/1994, as amended.

Every user who is legally capable according to the articles of the Greek Civil Code (having reached the age of eighteen and not under judicial support regarding the conclusion of a sales contract) has the ability to place a valid order through the e-shop. Legal entities' representatives can also place orders, and the company reserves the right to demand from the supervisor or guardian any orders made by legally incapacitated persons.

 

8. LIMITATION OF LIABILITY

The company is not liable for covering claims of any kind that may arise in connection with the use, copying, or alteration of www.nima.gr or its content, or any other linked site by third parties not authorized by the Company, whether or not the Company was informed, aware, or should have been aware of this possibility.

www.nima.gr is not responsible to its customers/users for damages that may arise from the use of www.nima.gr services and content, initiated by them with their own initiative and knowledge of these terms (except for cases of paragraph 11, "RETURN POLICY").

Users acknowledge that www.nima.gr is entitled to modify and/or temporarily or permanently suspend all or part of it, with or without notice to users, as availability may be affected by user equipment, other communication networks, the large number of people trying to use www.nima.gr simultaneously, or other causes. Therefore, www.nima.gr assumes no responsibility for any kind of damage (positive, consequential, negligent, contractual, or other) arising from users' inability to access it, the cessation of all or part of it, the delay, non-delivery, interruption, or poor quality of their services or the loss of their content, the existence of any errors. In any case, www.nima.gr reserves the right to suspend temporarily or permanently the operation of the whole or part of it for maintenance or upgrading reasons or for any other reason.
 

The company does not guarantee and cannot know whether the data and/or information provided by users at the time of their registration on www.nima.gr are true and/or accurate.

In case of any violation of these terms and/or any statement and/or guarantee provided by the user found to be, even partially, untrue and/or groundless, the user expressly acknowledges that the company is released from any kind of liability, damage, debt, expense, cost (including, illustratively and not restrictively, any legal expenses), and generally from any liability and claim raised by third parties.

 

9. ORDERS - PRODUCT DELIVERY - SHIPPING COSTS

The online store www.nima.gr delivers its products all over Greece. Shipments are not made to Cyprus and foreign countries.

Shipments are made daily except on Saturdays, Sundays, public holidays, and general strikes, during the delivery hours of the cooperating courier companies. The above delivery days and hours are exempt in cases where the courier company cannot fulfill the delivery due to its own fault.

The prices listed on the website are in Euros and include all applicable taxes (24% VAT), except for shipping costs. www.nima.gr reserves the right to change prices without prior notice to customers. In any case, the customer will pay the price that was indicated at the time of placing the order upon delivery of the product.

In the case of a discount coupon, the user should be aware that discount coupons have a specific duration and are applied on the checkout page of the order. Only one discount coupon can be used per order.

Upon completion of the order, the customer will receive confirmation and the order number via email from www.nima.gr, including a summary of the ordered products, as well as billing and shipping addresses. If the customer wishes to cancel or modify the order, they must contact the online store either by email at [email protected] or by calling 210 2400100. In these cases, the order may be canceled or modified, provided that the shipping process has not commenced.

Orders are executed based on the company's available stock, and therefore, the product availabilities mentioned are indicative and not binding. If any of the products are not available in stock, the company undertakes to contact the user via email within 2 working days from the order date, informing them of the deadline within which the product can be delivered or the possible complete lack of the specific product. If the user finds the delivery time unsatisfactory, they can cancel the order for that particular product, while the rest of their order can proceed normally.

Upon shipment of the order, the user will receive the order voucher number and a link via email from www.nima.gr. By following the link, the user can track the shipment status. Delivery is made within 15 days from the order date at the latest and depends on the availability of the products. In exceptional cases and if the customer has been informed in advance, the delivery time may be extended.

Shipping of products is exclusively handled by the Hellenic Post (courier company). Shipping costs are €3.00.
The cash on delivery fee is €2.00.

In the event that a customer refuses to accept the products more than 3 times, www.nima.gr reserves the right to charge the customer for the total shipping costs or to refuse the shipment of the products.

10. PAYMENT METHODS

The following payment methods are available for users to pay for their orders:

Cash on Delivery

Payment in cash upon delivery of the order by the transport company, with an additional charge of €2.00.
In the case of cash on delivery, the total amount of the order cannot exceed €500.00.

Credit/Debit Card

Upon completing the order, users can choose to pay with Visa, MasterCard, Maestro, American Express, or Diners credit/debit/prepaid cards. Users will be redirected to the secure payment page of Alpha e-Commerce service. In any case of purchase, the buyer must be the cardholder used for the transaction.

Paypal

Online payment through PayPal service. PayPal ensures the security of electronic transactions and allows users with a PayPal account to use this payment method, avoiding entering card details each time.

During the deposit, users are recommended to include their order number for faster processing.

MasterPass

Payment using the MasterPass digital wallet. Masterpass by Mastercard is a simple, easy, and reliable digital platform for faster and safer online shopping at thousands of businesses on the internet, storing all bank digital wallets.

For all five payment methods mentioned above, users have the option to choose between a retail receipt or an invoice.

An invoice is issued for companies and freelancers if they provide the following details when placing their order: company name, activity, VAT number, tax office, mobile, and landline phone.

 

11. RETURN POLICY

Users have the right to return products purchased from this online store in the following cases:

a) Returns with charge to "NIMA S.A. Bedlinen"
1. If products were sold by www.nima.gr due to mistakes in order processing, invoicing, shipping, etc., the customer has the option either not to accept the product from the beginning or to request a refund.

2. If products of poor quality were sold by www.nima.gr (damaged during transportation, defective items, etc.), the customer has the option either not to accept the product from the beginning or to request a refund. 


b) Returns with customer charge
The customer has the right to return the products purchased, without stating the reason, within fifteen (15) calendar days from the delivery date. In this case, the customer bears the specified cost of product return. Returns will only be accepted if an email has been sent to [email protected] or if there has been prior phone contact with the online store at 210 2400100 within the aforementioned deadline.

In all the above cases, for the return to be accepted, the products must not have been washed, the packaging must not have been damaged, they must retain all their original labels, and they must be accompanied by a copy of the sales document (retail receipt or invoice).

In case of product returns, the refund corresponding to the products ordered by the customer will be completed within 15 days from the date that www.nima.gr receives the returned products. The refund can be made either by crediting the user's account in the online store for future use or to a bank account provided by the customer to www.nima.gr in a timely manner, either by sending an email to [email protected] or by phone contact with the online store at 210 2400100.

 

12. APPLICABLE LAW

The terms of use of this agreement are governed by Greek Law. In case any term and/or condition is found to be null and/or not applicable under the law, even partially, the terms and/or conditions unaffected by the defects will continue to be valid and effective.

 

13. JURISDICTION

For any dispute that may arise regarding the interpretation, validity, and/or execution of this agreement, the Courts of Athens are exclusively competent to settle any dispute.
